Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not provide a place of employment that was free from recognized hazards that were likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: On or about September 28, 2012, The Caterpillar 924H, Sn: HXC3092 front end loader was used to lift an employee(s) in the bucket of the loader to gain access to the girder and wall section of a highway bridge that was being repaired. While being elevated in the bucket, the employee(s) were exposed to a fall of approximately 10 feet to the dirt ground below.
