Employees working from a 4 in 12 pitch roof were exposed to falls of approximately 12.6 feet to a lower level. The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person.

29 CFR 1926.95(b): "Employee-owned equipment." Where employees provide their own protective equipment, the employer shall be responsible to assure its adequacy, including proper maintenance, and sanitation of such equipment. Employee was using sunglasses that were not ANSI rated while using a pneumatic nail gun shingling. The employer failed to inspect the employees personal gasses to ensure they were ANSI rated before allowing him to use them.
