29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace A.E. Schlueter Pipe Organ Company, Inc. - on or about October 5, 2012, two employees voluntarily wear half-face tight fitting respirators when dust is created by cutting wood parts and when applying paint. The employees had not received evaluations to determine that they were medically able to wear the respirators and that respirator use itself did not present a hazard.
