29 CFR 1926.451(c)(1): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) shall be restrained from tipping by guying, tying, bracing, or equivalent means, as follows:      Location: 42 West Street, Brooklyn, NY. 5th level roof elevator shaft.    a)     The 4 section high tubular welded frame scaffolds were not restrained from tipping by guying, tying or equivalent means. Employees used the tubular welded frame scaffolds to construct the bulkhead on the roof and it was not restrained by any means. On or about 09/18/2012.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY of 1,000.00, IN ACCORDANCE WITH 29 CFR 1903.19

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.    Location: 42 West Street, Brooklyn, NY. (The Roof).    a)    Employees climbed the crossbraces and frames to access the work areas when working from the scaffold to construct the bulkhead. On or about 09/18/2012. 29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces shall be protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.    Location:     42 West Street, Brooklyn, NY. 5th level roof elevator shaft.    a)     The floor hole/demolished stairwell shaft on the 5th floor was not protected by use of guardrails or other fall protection system.  The shaft was used to hoist construction materials such as blocks and sand. An employee fell down the shaft while working near the shaft. On or about 09/25/2012.
