29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets. a) At Lot #6 Cedar Ridge Drive, Millsboro, DE - Employees were not wearing or using PPE such as but not limited to: head or eye protection while working on the residential construction site. Employees were cutting wood materials at ground level below the roofing work areas, and lifting the sheathing up to the roof for installation, without the use of head protection. This exposed them to potential head and eye injuries or imparement. The violation was observed on or about September 25, 2012.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system: a) At Lot #6 Cedar Ridge Drive, Millsboro, DE - Employees observed working on a 9/12 pitch roof of a residential construction site, approximately 25-30 feet above the ground, without fall protection. The employees were installing roof sheathing. This exposed the employees to injuries from fall hazards. The employees had the PFAS equipment on site, but were not wearing it as required. The violation was observed on or about September 25, 2012.
