29 CFR 1910.1026(d)(1): Each employer who has a workplace or work operation covered by this section did not determine the 8-hour TWA exposure for each employee exposed to chromium (VI). This determination had not been made in accordance with either paragraph (d)(2) or paragraph (d)(3) of this section. Production floor-Wipe sampling conducted on October 15, 2012 revealed the presence of hexavalent chromium.

29 CFR 1910.1200(e)(1): Employer had not developed, implemented, and maintained at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met. Establishment-There was no written program. In addition to welding materials, employees used chemicals such as but not limited to automotive fluids and ispropyl alcohol.
