29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents. On or about October 2, 2012, employees at a commercial construction site cutting concrete using a TS 400 A (EWC) STIHL Cutquik Cut Off Saw and a HILTI 3000-AVR Jack Hammer Machine were not provided eye and face protection. Employees were exposed to eye and face injuries.

29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification: On or about October 2, 2012, employees at a commercial construction site were breaking concrete using a HILTI 3000-AVR Jack Hammer Machine were using an extension cord modified with a handy box. The metal box was not used as per U.L listing exposing employees to electrical shock hazards.
