29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards; note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard: a) Employees were walking/working on the top surfaces of Freightliner and International fuel tank trucks at a height greater than seven and one half (7.5) feet above pavement without utilizing fall protection equipment on the south side of a stationary fueling station structure. ABATEMENT CERTIFICATION AND ABATEMENT DOCUMENTATION REQUIRED.

29 CFR 1910.23(e)(3)(v)(c): Protection between top rail and floor, platform, runway, ramp, or stair treads, equivalent at least to that afforded by a standard intermediate rail was not provided: a) Employees were walking/working from the top surfaces of Freightliner and International fuel tank trucks at heights greater than seven and one half (7.5) feet above pavement without any fall protection between a fueling station's top guardrail and the truck's runway surface. ABATEMENT CERTIFICATION AND ABATEMENT DOCUMENTATION REQUIRED.
