Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that employees were exposed to fall hazards: (a) On or about 10/3/2012 - 600 Beacon Parkway West, Birmingham, AL, employees cleaning exterior windows utilizing a Rope Descend System (RDS #1, #2, #3) were not protected from falls in that the safety line and the primary working line were attached to the same anchorage point. (b) On or about 10/3/2012 - 600 Beacon Parkway West, Birmingham, AL, employees cleaning exterior windows utilizing a Rope Descend System (RDS) were not protected from falls in that the equipment used was not engineered, designed or approved by the original manufacturer or a registered professional engineer.

29 CFR 1910.28(j)(4): The worker was not protected by a safety life belt attached to a lifeline securely attached to substantial members of the structure (not scaffold) or to securely rigged lines, which would safely suspend the worker in case of a fall: (a) On or about 10/3/2012 - 600 Beacon Parkway West, Birmingham, AL, employees cleaning exterior windows utilizing a Rope Descend System were not protected from falls in that the safety line was not designed to safely suspend the workers in case of a fall.
