29 CFR 1926.451(a)(6): Scaffolds were not constructed in accordance with the design by a qualified person: a) On or about October 3, 2012 and times prior at 130 Yacht Basin Drive, Demopolis, AL 36732; The employer failed to ensure a qualified person designed the Haul Master rolling scaffold when it was built above the manufactures maximum height of two stages. The scaffold was built five stages high without design specifications by a qualified person as to load limits which exposed employees using the scaffold to access a roof approximately 23 feet high to fall hazards. b) On or about October 3, 2012 and times prior at 130 Yacht Basin Drive, Demopolis, AL 36732; The employer failed to ensure a qualified person designed the Haul Master rolling scaffold when it was built above the manufactures maximum height of two stages. The scaffold was built five stages high without design specifications by a qualified person as to proper support locations such as but not limited to guys, ties, or braces to support both inner and outer legs to prevent tipping due to the scaffold exceeding the 4:1 height ratio, which exposed employees using the scaffold to access a roof approximately 23 feet high to fall hazards.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity: a) On or about October 3, 2012 and times prior at 130 Yacht Basin Drive, Demopolis, AL 36732 : The employer failed to ensure the competent person prior to allowing employees to use a Haul Mounting rolling scaffold to access the working level of the metal roof being installed over marina boat slips. The scaffold was unsafe for use due to items such as but not limited to building the scaffold 5 bucks high when the manufacture only allows 2 bucks high, improperly securing the scaffold with a tie down strap, and no fall protection installed on top level platform which employees walked across to access the roof.
