29 CFR 1910.178(p)(1): Where powered industrial trucks were found to be in need of repair, defective, or in any way unsafe, the trucks were not taken out of service until they had been restored to safe operating condition On or about Wednesday October 3, 2012 in the production area of the facility; a). Employees operated the powered industrial truck daily or as needed to move metal material around and throughout the production area with deficiencies such as but not limited to: 1. Hand brake not functioning properly to hold the equipment in place when unattended with the engine running or parked on a incline. 2. Propane mounting bracket broken and able to secure the propane tank properly from falling and causing a fire hazard. 3. Horn not functioning properly to warn employees working and walking in the area.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: On or about Wednesday October 3, 2012 in the maintenance shop area of the facility; a). The employee troubleshooting and removing the starter under the powered industrial truck was not provided specific energy control procedures to protect the employee from a crushing hazard while working under the equipment. Elite Storage Solutions, Inc. was previously cited for a violation of this OSHA standard or it's equivalent standard which was contained in OSHA inspection 311038517, citation 1, item 2a, issued on 3/26/2008. The citation became final order on 4/15/08.
