29 CFR 1910.178(a)(4): Modifications and additions which affected capacity and safe operation were performed by the customer or user without manufacturers written approval, and the capacity, operation and maintenance instruction plates, tags or decals were not changed accordingly. On or about June 27, 2012, and times prior thereto, a basket was used to lift employees to gain access to the top of shipping containers in the yard by lifting it with a fork lift. The basket was not an approved addition by the fork lift manufacturer. This condition exposed employees to a fall of approximately 9.5 feet to the ground below.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operators performance was not conducted at least once every 3 years. On or about June 27, 2012 and times prior thereto, three fork lift operators (current employees) were operating fork lifts (Powered Industrial Trucks) at the employers yard and the operators performance evaluation had not been performed within three years. This condition exposed employees to potential struck-by hazards.
