OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards:    a. On or about October 1, 2012, in the rail yard, the 20,000-lb rail car shaker hoist had several issues wrong with it, exposing employees to being struck by suspended loads. The following defects were noted;    no periodic or frequent inspection  Hook had safety latch removed  Rigging had the clamps installed backward and were not forged steel  The capacity was not clearly marked on the hoist or hoist tower  Wire rope used for the lift wire was not attached with a thimble  Electrical junction box 8-foot up the superstructure had the wires chaffing out of the box  Tension cable disconnected on electrical leads to junction box   No safety shackle between shaker unit and hoist  Lift wires dry and rusting      Among other methods, one feasible and acceptable abatement methods to correct this hazard is to have the capacity on the hoist in accordance with ANSI B.30-2007 and have the hoist inspected within the prescribed periodicity of the ANSI B30.16- 2007    ANSI B30.16-1973 16-2 Electric or air powered hoists, Section 16-2.1 Marking, construction, and installation, 16-2.1.1 Markings, 16-2.1.1.1 Rating; The rated load capacity shall be permanently marked on the hoist or load block and clearly legible from the operating position.    ANSI B30.16-2007 16-2.2 Inspection, Testing, and Maintenance, 16-2.2.1 Inspection, 2. Periodic Inspection - One to twelve month intervals, or as specified by the manufacturer.    Manufacturers periodic inspection requirements found in the manufacturers operators and parts guide page 5, section IV Inspection paragraph 4-3    Repair all issues listed wrong with the hoist

On or about October 1, 2012, in the maintenance shed near the asphalt manufacturing area, the oxygen manifold on the cylinder had a broken oxygen pressure gauge, exposing employees to explosive hazards.    b. On or about October 1, 2012, on the maintenance truck in the rail aggregate yard, the acetylene gauge manifold had broken gauges, exposing employees to explosive hazards.    OR IN THE ALTERNATIVE:     OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were using damaged oxygen/acetylene gauge manifolds, exposing themselves to explosive hazards:    a. On or about October 1, 2012, in the maintenance shed near the asphalt manufacturing area, the oxygen manifold on the cylinder had a broken oxygen pressure gauge, exposing employees to explosive hazards.    b. On or about October 1, 2012, on the maintenance truck in the rail aggregate yard, the acetylene gauge manifold had broken gauges, exposing employees to explosive hazards.    Among other methods, one feasible and acceptable abatement methods to correct this hazard is to follow:   ANSI Z49.1-1973, Safety in Welding and Cutting, 1. Scope, 1.3 Equipment. Oxy-Fuel gas and electric welding, cutting, and heating equipment shall be kept in working condition, inspected as necessary to be sure it can be kept in working condition, when found to be defective (incapable of reliable operation) shall be promptly repaired by qualified personal or withdrawn from service.    Or    Manufacturer Victor Single and Two Stage Regulators, Safety and Operating Instructions page 3-8, WARNING:    DO NOT attach or use the regulator if oil, grease, flammable substances or damage is present! Have a qualified repair technician clean the regulator or repair any damage.
