29 CFR 1926.1101(k)(2)(ii)(A):     Building and/or facility owners failed to notify prospective employers applying for or bidding for work whose employees can reasonably be expected to work in or adjacent to areas containing asbestos containing material or presumed asbestos containing material of the presence, location and quantity:    a)  The company did not inform B & M Contractors, LLC of the presence of asbestos containing material (ACM) or potentialy containing asbestos material (PACM) prior to the contractor starting work or agreeing to work performing the demolition/rehabilitation construction of the bathroom area on the forth floor of the building.

29 CFR 1926.1101(k)(7)(i):     Warning signs that demarcated the regulated area were not provided and displayed at such a distance from regulated areas that an employee may read the signs an take necessary protective steps before entering the area marked by the signs:    a)  The company did not require or post any warning signs for the construction project on the fourth floor to identify the presence of asbestos materials to warn employees working in adjacent area of the danger of entering the construction area.
