29 CFR 1926.501(c)(3):     The employer did not barricade the area to which objects could fall, did not prohibit employees from entering the barricaded area, or did not keep objects that could fall far enough away from the edge of a higher level so that the  objects would not go over the edge if they were accidentally displaced.    a) Entrance area at the southwest end of the structure; On or about October 2, 2012 and at times prior thereto, an employee was sawing off overhanging decking at the third floor level and allowing it to drop off to the ground below.    b) Entrance area at the northwest end of the structure; On or about October 2, 2012 and at times prior thereto, an employee was sawing off overhanging decking at the third floor level and allowing it to drop off to the ground below.    Note: Abatement certification IS required for this item.

29 CFR 1926.501(b)(13):     Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a) North side at mid-point of the structure, third floor level; On or about October 2, 2012 and at times prior thereto, as the controlling employer, a subcontractor's employee installing floor joists blocking was allowed to walk on/work from the top of the exterior and interior walls without a means of fall protection.     b) North side at east end of the structure, third floor level; On or about October 2, 2012 and at times prior thereto,  as the controlling employer, a subcontractor's  employee installing floor joists blocking was allowed to walk on/work from the top of the exterior and interior walls without a means of fall protection.     c) West end of structure, both north and south side, third floor level; On or about October 2, 2012 and at times prior thereto,  as the controlling employer, a subcontractor's employees were allowed to lay decking up to the immediate exterior edge without a means of fall protection.     Note: Abatement certification and documentation ARE required for these items.    Bach Land & Development, LLC was previously cited for a violation of this Occupational Safety and Health standard which was contained in OSHA inspection 311576284, Citation 01, Item 002a, and was affirmed as a final order on 6/20/08 with respect to a workplace located at 2785 Eagle Drive, Ammon, ID.
