29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions had been taken to ensure their safety: (a) Public Service Company of Colorado at 2655 N. 63rd St., Boulder, CO 80301: On and before August 22, 2012 the competent person did not remove employees from a trench in which hazardous conditions existed located at 895 W. 136TH Ave., Broomfield, CO, in that an employee was hand digging with a shovel to expose a gas pipeline and apply a squeeze jack to stop the gas flow. Work was allowed to continue despite the fact that soil kept sliding/sloughing into the trench where an employee was working. This condition exposed employees to cave-in and struck-by hazards.
