29 CFR 1926.652(a)(1):   Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:    Employees were working in an approximately 23 feet 9 inch by 13 feet 2 inch and 7 feet 8 inches deep excavation were exposed to cave-in hazards, and the employer did not use cave-in protection.
