OSH ACT of 1970 Section (5)(a)(1): 29 CFR Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to thermal burn hazards: Establishment: Ice Coffee Machines: Employees are exposed to thermal burns from hot water while measuring and carrying open buckets of 200 degree F water AND; employees are exposed to thermal burns from hot water stream of 200 degree F from machine to container; On September 28, 2012, an employee sustained second degree burns while measuring when the open container spilled approximately 1.25 gallons of 200 degree F water on the employees legs and feet.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: Establishment: Employer did not provide and/or ensure the use of the following personal protective equipment for the following tasks: a) Waterproof, thermal gloves for employees who handle buckets of scalding hot water while measuring water volume of the iced coffee machine. b) Footwear that entirely covers the foot while performing tasks such as preparing food and beverage and transporting them to customers.
