29 CFR 1926.102(a)(1):  Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.    The employer does not protect employees from eye injuries.  This violation was observed on or about October 4, 2012, at the job site where employees were exposed to a struck by hazard when using pneumatic nail guns and were not wearing eye protection.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from eye injuries.

29 CFR 1926.501(b)(1):  Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    The employer does not protect employees from falls when six feet or more above a lower level.  This violation was observed on or about October 4, 2012, at the job site where employees were exposed to a twelve foot seven inch fall hazard when installing decking material without a fall protection system.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falls.

29 CFR 1926.1053(b)(1):  Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    The employer does not protect extend ladders at least three feet above the upper landing surface.  This violation was observed on or about October 4, 2012, at the job site where employees were exposed to a fall hazard when using a ladder without the ladder's side rails extended three feet above the roof line.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected falls from ladders.
