29 CFR 1910.106(b)(6): In locations where flammable vapors may be present, precautions were not taken to prevent ignition by eliminating or controlling sources of ignition.  Sources of ingition may include open flames, lightning, smoking, hot sirfaces, frictional heat, sparks (static, electrical, and mechanical), spontaneous ignition, chemical and physical-chemical reactions, and radiant heat:    The employer does not ensure that adequate precautions are taken to prevent the ignition of flammable vapors. This violation occurred on or about October 02, 2012, At the Ferguson Prison Unit 8 Well # 1 where employees were exposed to explosion and fire hazards when performing painting activities to the well tank battery using an electric spray painting rig without eliminating or controlling sources of ignition.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that adequate precautions are taken to prevent the ignition of flammable vapors.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered.    The employer does not provide flame-resistant clothing (FRC) necessary to protect employees from burns due to potential flash fires. This violation occurred on or about October 02, 2012 and at times prior thereto at the Ferguson Prison Unit 8 Well # 1 production facility where employees were exposed to the hazard of flash fires without the protection of flame-resistant clothing.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees use flame-resistant clothing when there is a potential flash fires.

The employer does not report orally the death of an employee or the in-patient hospitalization of three or more employees that resulted from a work-related incident On or about October 02, 2012 the employer failed to report to OSHA a work-related incident that resulted in the hospitalization of three employees within eight hours.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all work related incidents that resulted in the hospitalization of three or more employees are reported within eight hours.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.    The employer has not developed or implemented a written hazard communication program that describes how they comply with this standard regarding labels and other forms of warning, material safety data sheets, and employee information and training. This violation occurred on or about October 02, 2012, and at times prior thereto, when employees in the facility were required to handle hazardous chemicals before a written hazard communication program had been developed and implemented.          Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a written hazard communication program is developed, implemented, and maintained that includes the criteria specified in 29 CFR 1910.1200(f-h).
