29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: Employees working at the Flemming Select Stone Machine were exposed to injury and illness. Employees working in Plant #2 were exposed to hearing loss from excessive noise exposure and had not been provided with annual audiometric testing. 29 CFR 1903.19(c)(2) abatement for the above violation was verified at time of inspection, no certification is required.

29 CFR 1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k): Employees working at the Flemming Select Stone Machine were exposed to injury and illness. Employees working in Plant #2 were exposed to hearing loss in that they had not received training required by this standard such as but not limited to the correct use and limitations of hearing protection. 29 CFR 1903.19(c)(2) abatement for the above violation was verified at time of inspection, no certification is required.
