29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: (a) On or about 10/2/12 an employee assisting in the installation of wood panels was observed standing under an aerial lift at the construction of the Wendys Restaurant at US highway 301 Riverview FL. The employee that was not wearing head protection was exposed head injuries from falling objects.

29 CFR 1926.453(b)(2): A body belt was not worn and a lanyard was not attached to the boom or basket when working from an aerial lift: A- On or about 10/2/12 a Genie S-40 Telescopic Boom Lift rented from Neff Rental was used at the construction of the Wendys Restaurant at US highway 301 Riverview FL. Two employees wearing full body harnesses were not connect to the anchor point of the lift exposed to a fall of approximately 20 feet.
