29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.      On or about 10/05/2012, the employer did not create a hazard communication program to address the hazardous chemicals employees would be using as part of their daily tasks. These chemicals include, but are not limited to Window Cleaner, Pledge, Lysol, Fabuloso, Goo Gone, Raid Insecticide, and Bleach.      Z Gallerie, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1200(e)(1), which was contained in OSHA inspection number 316327063, citation number 1, item number 1 and was affirmed as a final order on July 2, 2012, with respect to the workplace located at 309 Plaza Real, Boca Raton, FL 33432.

On or about 10/05/2012 the employer did not have material safety data sheets available for the chemicals, including but not limited to Bleach, Windex, Fabuloso, Googone, and Plege, which are used by employees.    Z Gallerie, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1200(g)(1), which was contained in OSHA inspection number 316327063, citation number 1, item number 2 and was affirmed as a final order on July 2, 2012, with respect to the workplace located at 309 Plaza Real, Boca Raton, FL 33432.

29 CFR 1910.1200(h)(1): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area.    On or about 10/05/2012 the employer did not provide training to employees to address the health hazards associated with the use of hazardous chemicals such as but not limited to: Bleach, Fabuloso, Googone Pro Power, Window Cleaner, Liquid Plumber, Woolite Fabric & Upholestry Foam which they are required to use for cleaning areas of the facility.      Z Gallerie, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1200(h)(1), which was contained in OSHA inspection number 316327063, citation number 1, item number 3 and was affirmed as a final order on July 2, 2012, with respect to the workplace located at 309 Plaza Real, Boca Raton, FL 33432.

29 CFR 1910.1200(f)(9): The employer did not ensure that labels or other forms of warning were legible, in English, and prominently displayed on the container, or readily available in the work area throughout each work shift.    On or about 10/05/2012, in the stock room of Z Gallerie there were two unlabeled containers filled with a blue liquid among the cleaning chemicals used by employees.
