NOTE: Because abatement of this violation is already documented in the inspection case  file, the employer need not submit certification or documentation of abatement for this  violation as normally required by 29 CFR 1903.19.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    Location: 77 Locust Hill Ave. Yonkers, NY    a)  Employees pour, mix and apply Portland cement and the employer did not ensure the use of personal protective equipment for the eyes and hands; on or about 10/3/12.    b) An employee was cutting up stone using a jackhammer without eye protection; on or about 10/3/12.        NOTE: Because abatement of this violation is already documented in the inspection case  file, the employer need not submit certification or documentation of abatement for this  violation as normally required by 29 CFR 1903.19.
