Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment that was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by/crushing hazards associated with a modified and defective  hydraulic automotive lift:  	  a) For the Dealers Choice Auto Repair, LLC auto shop at 1003 N Washington Blvd., Sarasota, FL 34236, as observed on or about 10/09/2012, employees were exposed to crushing hazards while working underneath a hydraulic lift used for vehicle alignments and other repairs. The lift had been welded onto and modified from its original design, had hydraulic leaks, no rated load capacity, and safety locks/restraints that did not secure the lift at all elevated working locations.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:    a) For the Dealers Choice Auto Repair, LLC auto shop at 1003 N Washington Blvd., Sarasota, FL 34236, as observed on or about 10/09/2012, an eyewash station was not available for employees who worked with or were potentially exposed to corrosive chemicals such as brake cleaner or battery acid.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a) For the Dealers Choice Auto Repair, LLC auto shop at 1003 N Washington Blvd., Sarasota, FL 34236, as observed on or about 10/09/2012, chemicals such as, but not limited to, oils, brake cleaner, transmission fluids, and various cleaners and lubricants were used on a daily basis. No written hazardous communications program was in place for the facility.
