29 CFR 1910.22(d)(1):     On every building or other structure, or part thereof, used for mercantile, business, industrial or storage purposes, the loads approved by the building official were not marked on plates of approved design and securely affixed in a conspicuous place in each space to which they relate.    On or about October 5, 2012 and times prior thereto, employees of J.C. Penney retrieved mannequins stored on a top shelf in the Visual Room located at 2202 Bellview Road in Rogers, Arkansas.  The employees climbed onto the top shelf which stored mannequins and the shelf was not marked with the load capacity, exposing employees to a 12 feet falling distance in the event the shelf was overloaded.

29 CFR 1910.23(c)(1):     Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:  Note:  Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard.    On or about October 5, 2012 and times prior thereto, employees of J.C. Penney, retrieved mannequins from a top shelf in the Visual Room located at 2202 Bellview in Rogers, Arkansas.  Employees accessed the shelf with the use of a ladder and climbed onto the shelf to retrieve mannequins and other stored materials.  The shelf was not guarded to protect employee from falling, exposing them to a falling distance of 12 feet to the ground level below.
