29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part:    On or about October 5, 2012, during construction activities including but not limited to roofing activities on a low sloped roof, the employer did not have a safety and health program implemented at the worksite. The employer did not ensure that employees were provided safety and health training or that there was a system in place to recognize and correct unsafe working conditions.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    On or about October 5, 2012, during construction activities including but not limited to roofing work, the employer did not ensure employees were protected from possible head injuries by ensuring head protection was provided and worn by employees.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and fuardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:    On or about October 5, 2012, during roofing activities including but not limited to installing a standing seam metal roof, the employer did not ensure all employees on the roof were using a fall protection system/device on a low sloped roof with a fall height approximately 10.8 feet in the front and 13.7 feet in the rear.
