On or about October 2, 2012, an employee at the cement manufacturing plant handled hazardous chemicals such as, but not limited to, bags of Portlant Cement, Diesel fuel, ready mix concrete and Parafill, and the employer had not developed, implemented, and/or maintained an adequate hazard communication program.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: a. On or about October 1, 2012, employees working at the ready mix cement facility were not provided with adequate and effective training on the health and physical hazards of hazardous chemicals such as, but not limited to, portland cement, ready mix cement, diesel fuel, and parafill.
