29 CFR 1910.134(c)(1):     A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    (a) The employer required its employees to wear filtering facepiece respirators when spraying flowers or props with spray paint. The employer also had a half-mask respirator with cartridges available for use by employees on a voluntary basis. The employer does not have a respirator program despite requiring the use of respirators, and having a respirator which requires elements of a written program.    Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.134(e)(1):     The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:    (a) The employer required its employees to wear filtering facepiece respirators when spraying flowers or props with spray paint. The employer also had a half-mask respirator with cartridges available for use by employees on a voluntary basis. The employer does not have a respirator program despite requiring the use of respirators, and having a respirator which requires elements of a written program. The employer did not conduct medical evaluations of its employees who wear respirators.    Note:  The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.    Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

The employer also had a half-mask respirator with cartridges available for use by employees on a voluntary basis. The employer does not have a respirator program despite requiring the use of respirators, and having a respirator which requires elements of a written program. The employer did not conduct fit testing for its employees which are required to wear a respirator.    Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
