29 CFR 1904.39(a):     The employer did not orally report the death of an employee or the in-patient hospitalization of three or more employees because of a work-related incident.     On or about October 6, 2012, the employer failed to report an employee fatality.   On September 29, 2012, an employee sustained an injury at the worksite located at 135 S. Byrne in Toledo, Ohio, that injury resulted in the death of the employee on October 6, 2012.  The employer did not report the employee fatality within 8 hours after the death.
