29 CFR 1926.416(a)(1) Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means: At the jobsite, employees were performing roofing activities upon a commercial roof. Insulated electrical power lines were attached to the fence on the roof. Employees used an aluminum extension ladder to gain access/egress from this commercial roof and had been working within five feet of the insulated power lines. OR IN THE ALTERNATIVE: 29 CFR 1926.1053(b)(12) Ladders used where the employee or the ladder could contact exposed energized electrical equipment did not have nonconductive side rails: At the jobsite, employees were performing roofing activities upon a commercial roof. Insulated electrical power lines were attached to the fence on the roof. Employees used an aluminum extension ladder to gain access/egress from this commercial roof and had been working within five feet of the insulated power lines.

29 CFR 1926.501(b)(11) Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: At the jobsite, employees were performing roofing activities upon a commercial roof without using a form of conventional fall protection. Harnesses were worn but employees were not tied off. The ground to eave height was approximately 10 feet 5 inches. The slope was measured approximately 22 degrees from the horizontal or 5:12.
