OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. a) At the establishment, on or about October 10, 2012, a power industrial truck model, TMC 22273, was used to elevate an employee while standing on a pallet which was being used as a work platform , exposing him to a fall hazard of 10 feet to the concrete below.
