29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent persons designated by the employers.      On or about October 9, 2012 the employer did not maintain a program to ensure employees were competent, preforming frequent safety inspections and not working under unsanitary, hazardous or dangerous conditions.

29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form and scrap lumber with protruding nails, and all other debris, shall be kept cleared from work areas, passageways, and stairs, in and around buildings or other structures.     On or about October 9, 2012, on the south side of the construction site, a pile of debris had accumulated near the entrance to the jobsite, exposing employees to the hazards of lacerations and/or puncture injuries caused by stepping on nails.

29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.    On or about October 9, 2012 employees preforming framing work were working at various levels without hard hats. Employees were using hand and pneumatic tools and throwing framing material to lower levels and on to the ground.  Employees were exposed to the hazard of being struck-by falling or flying objects.

29 CFR 1926.451(b)(2):  Scaffold platforms and walkways were not at least 18 inches wide:    On or about October 9, 2012 , on the eastside of the house, employees were working on a plank that was approximately 9 inches wide while performing cornice work.  The employees were exposed to falls of approximately 19 feet to the ground below.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    On or about October 9, 2012, on the  eastside of the residential property, employees were performing cornice work from a scaffold without being protected from falling to the ground below by having any type of fall protection. The employees were exposed to fall hazards of approximately 19 feet to the ground below.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.    On or about October 9, 2012, employees performing framing work on  a residential home were not protected from fall hazards of more than 20-feet to the lower level.
