29 CFR 1926.453(b)(2)(v):     A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.  Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).    a. At the facility, employees performing construction work on the powder coat building were working from two aerial lifts installing metal siding and metal roof components without the use of a harness and lanyard.

29 CFR 1926.454(a)(1):     The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:    The nature of any electrical hazards, fall hazards and falling object hazards in the work area;    a.  At the site, where employees were assigned to perform construction work from an aerial lift, the employees did not receive fall protection training specific to the equipment that they were using.

29 CFR 1926.760(a)(1):     Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems.    a.  At the facility employees that were assigned construction duties to install metal decking on the roof of a steel pole building, were not protected from falls while working at a height of approximately 20 feet.
