OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that; employees were exposed to fall and crushed by hazards when working from a dimensionally oversized work platform, which was supported by a rough-terrain fork lift: (a) Construction site located at Hwy 12 E in Menomonie, WI; Two employees were working from an elevated work platform which extended more than 10 inches beyond the wheelbase of a rough terrain forklift on either side. The basket extended 22-1/2 inches beyond the wheel base on either side.

29 CFR 1926.501(b)(4)(ii): Each employee on a walking/working surface was not protected from tripping in or stepping into or through holes by covers. (a) Dunn County Health Care Center in Menomonie, WI; Floor holes in building 1 and 2A were not covered during wall setting, wall bracing, column setting, and elevated truss setting activities. The floor holes were approximately 31 inches wide by 31 inches long by 7 inches deep.
