29 CFR 1910.1030(c)(1)(i)  Exposure Control Plan.  The employer, with employee(s) with occupational exposure as defined by paragraph (b) of this section, did not establish a written Exposure Control Plan designed to eliminate or minimize employee exposure.    On October 22, 2012, employees were found to have occupational exposure to bloodborne pathogens and no exposure control plan was available to employees.  The employer had a blank sample program from PTC Compliance Training Partners but had not completed the necessary evaluations to eliminate or minimize employee exposure to bloodborne pathogens.

29 CFR 1910.1030(g)(2)(i) Information and Training.  The employer did not train each employee with occupational exposure in accordance with the requirements of this section. Such training must be provided at no cost to the employee and during working hours. The employer shall institute a training program and ensure employee participation in the program.    On October 22, 2012, employees with occupational exposure to bloodborne pathogens were found to not have received training in the Exposure Control Plan.  Employees are performing dental procedures, which has resulted in occupational exposure to blood, and proper training has not been given to employees to eliminate or at least minimize employee exposure.

29 CFR 1910.1030(f)(2)(i) Hepatitis B Vaccination.  Hepatitis B vaccination is not made available after the employee has received the training required in paragraph (g)(2)(vii)(I) and within 10 working days of initial assignment to all employees who have occupational exposure unless the employee has previously received the complete hepatitis B vaccination series, antibody testing has revealed that the employee is immune, or the vaccine is contraindicated for medical reasons.    On October 22, 2012, employees were found to have occupational exposure to bloodborne pathogens and had not been offered the Hepatitis B Vaccination within 10 days of initial assignment.  Employees had not been offered the Hepatitis B Vaccination even though a variety of job classifications in the business have occupational exposure to blood.
