Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    Location: 45 E. 33rd St., New York, NY.    a) An employee at the construction site was not protected from falling at an unprotected side. The employee was wearing a harness but his lanyard was not tied off.  The employee was exposed to a potential fall of approximately 30 ft. to the ground below; on or about 10/9/12.

29 CFR 1926.502(b)(2):  Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structural members shall be installed between the top edge of the guardrail system and the walking/working surface when there is no wall or parapet wall at least 21 inches (53 cm) high.    Location: 45 E. 33rd St., New York, NY.    a) Employer failed to provide midrails on a guardrail system that was protecting a floor opening on the second floor of the construction.  An employee fell through the floor opening 26 ft. to the cellar floor while pouring concrete and other employees were also exposed to the fall hazard; on or about 10/9/12.
