29 CFR 1926.62(d)(1)(i): Each employer who has a workplace or operation covered by this standard did not initially determine if any employee may be exposed to lead at or above the action level: (a) On or about 10/12/2012, at Wooster Science Building, SUNY New Paltz, NY, for employees removing expansion joint caulk, interior window caulk, exterior window caulk, exterior door caulk and caulk from a walk-in cooler. Caulk contained lead in concentrations ranging between 6 mg/kg and 110,000 mg/kg. Air monitoring was not conducted to determine employee exposure to lead.

29 CFR 1926.62(l)(2): The employer did not assure that each employee is trained in the following: (i) The content of this standard and its appendices; (ii) The specific nature of the operations which could result in exposure to lead above the action level; (iii) The purpose and a description of the medical surveillance program, and the medical removal protection program including information concerning the adverse health effects associated with excessive exposure to lead (with particular attention to the adverse reproductive effects on both males and females and hazards to the fetus and additional precautions for employees who are pregnant); (iv) The engineering controls and work practices associated with the employee's job assignment including training of employees to follow relevant good work practices described in Appendix B of this section; (v) The content of any compliance plan in effect; (vi) Instructions to employees that chelating agents should not routinely be used to remove lead from their bodies and should not be used at all except under the direction of a licensed physician; and (vii) The employee's right of access to records under 29 CFR 1910.1020: (a) On or about 10/12/2012, at Wooster Science Building, SUNY New Palty, NY, for employees removing expansion joint caulk, interior window caulk, exterior window caulk, exterior door caulk and caulk from a walk-in cooler. Caulk contained lead in concentrations ranging between 6 mg/kg and 110,000 mg/kg.

29 CFR 1926.1101(f)(1)(iii): The employer did not determine representative 8-hour time weighted average (TWA) employee exposure on the basis of one or more samples representing full-shift exposure for employees in each work area: (a) On or about 10/12/2012, at Wooster Science Building, SUNY New Paltz, NY, for employees removing asbestos containing building material. Employer's TWA exposure assessments for all employees monitored was based upon a 5-hour sampling period.
