OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from falling stock. a) On or about October 16, 2012 and times prior in the warehouse: The employer failed to ensure damaged storage racks which had been struck at the base by forklifts, were repaired or that section of racks taken out of service until they could be repaired which exposed employees to the hazards associated with getting struck-by falling product and rack sections.

29 CFR 1910.303(b)(1)(viii): Safety of equipment was not determined using considerations for other factors which contributed to the practical safeguarding of employees using or likely to come in contact with the equipment a) On or about October 17, 2012 and times prior, the Wulftec Wrapper: The employer failed to ensure when employees were operating the Wulftec Wrapper Machine that they were protected from water leaking from the ceiling onto the equipment motors, electrical conductors or circuit parts which exposed them to electrical hazards.
