OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards from falling objects:    a) Terminal 3- The employer failed to ensure rope was anchored to the drum in a manner approved by the winch manufacturer on winches such as the winch at Gate K2 where large gauge electrical cables were suspended overhead by the subject winche(s).    b) Terminal 3- The employer failed to ensure winches were inspected each day the winch was used, to check the proper operation of the control mechanisms, limit devices, condition of ropes, condition of components, and check for loose, damaged, or missing structural components, at gates such as K1 ,K2, K3, K5, K7, K8, K9, K12, K13, K15, K16, K18, K19, K20, H6, H8, H9, H11B, H12, H15, H17, H18, L8, and L10 where large gauge electrical cables were suspended overhead by the subject winche(s).    c) Terminal 3- The employer failed to ensure winches were inspected frequently to check the condition of all components of the winch, at gates such as K1, K2, K3, K5, K7, K8, K9, K12, K13, K15, K16, K18, K19, K20, H6, H8, H9, H11B, H12, H15, H17, H18, L8, and L10 where large gauge electrical cables were suspended overhead by the subject winche(s).    d) Terminal 3- The employer failed to ensure winches were inspected periodically to check the condition of all components of the winch, at gates such as K1, K2, K3, K5, K7, K8, K9, K12, K13, K15, K16, K18, K19, K20, H6, H8, H9, H11B, H12, H15, H17, H18, L8, and L10 where large gauge electrical cables were suspended overhead by the subject winche(s).    e) Terminal 3- The employer failed to ensure ropes used on winches were inspected at least monthly and a dated report was maintained on file for gates such as K1, K2, K3, K5, K7, K8, K9, K12, K13, K15, K16, K18, K19, K20, H6, H8, H9, H11B, H12, H15, H17, H18, L8, and L10 where large gauge electrical cables were suspended overhead by the subject winche(s).    f) Terminal 3- The employer failed to ensure unreeling or uncoiling of rope was done as recommended by the rope manufacturer or a qualified person to avoid kinking or introducing a twist on winches at Gates such as Gates K1, K2, K3, K5, K7, K8, K9, K12, K13, K15, K16, K18, K19, K20, H6, H8, H9, H11B, H12, H15, H17, H18, L8, and L10 where large gauge electrical cables were suspended overhead by the subject winche(s).    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.305(g)(1)(i): Flexible cords and cables were not approved or conditions of use and location:    a) Terminal 3, Gate K20- The employer failed to ensure that flexible cords and cables that were used were approved for the conditions of use and location.  Flexible cables were used with cuts in the outer insulation and in that condition were not approved for use in an outdoor area where the cable would be exposed to the elements.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
