29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: Jobsite: Employees were inadequately trained in the procedures for installing a break switch and in the drop zone work procedures. As a result, an employee suffered a serious injury when a switch component fell and struck him.

29 CFR 1926.1431(a): The use of equipment to hoist employees was not prohibited except where the employer demonstrates that the erection, use, and dismantling of conventional means of reaching the work area, such as a personnel hoist, ladder, stairway, aerial lift, elevating work platform, or scaffold, would be more hazardous, or is not possible because of the projects structural design or worksite conditions. Jobsite: Including work on Structure 42 A personnel platform was used to hoist employees. One or more aerial lifts could have been used instead.
