OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to workers, in that employees were exposed to struck by and crushing hazards while working under defective automotive lifts: a) Auto Repair Shop Lift Number 1 - On or about October 11, 2012, an employee was observed standing below a vehicle raised overhead on an in-ground two post hydraulic vehicle lift where visible hydraulic oil was seeping from the floor at the base of the left lifting post, lift pads were badly worn, and there were no functioning lift locks for either lift post, exposing employees to a struck by and or crushing hazard. b) Auto Repair Shop Lift Number 3 - On or about October 11, 2012, an employee was observed standing below a vehicle raised overhead on an Ammco two post surface mounted hydraulic vehicle lift where the left lifting post lift lock was inoperable due to a broken cable, the lift pads were badly worn, the lift swing arm restraints were not functioning, and there was no top center support provided, exposing the employees to a struck by and or crushing hazard. c) Auto Repair Shop Lift Number 4 - On or about October 11, 2012, an employee was observed standing below a vehicle raised overhead on a Challenger model number E10, serial number 0911000000054298, two post surface mounted hydraulic vehicle lift, and the left post suspension wire rope was showing slack, exposing the employee to a struck by and or crushing hazard.
