29 CFR 1910.1200(e)(1):     Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  (Construction Reference: 1926.59)    Jobsite - On or about October 16, 2012 a written hazard communication program was not developed, implemented and maintained for employees using hazardous chemicals including, but not limited to, MINWAX Fast-Drying Polyurethane Clear Gloss, MINWAX Wood Finish Stain, (Red Chestnut) and Sunnyside 100% Mineral Spirits.

Jobsite - On or about October 16, 2012 employee applied MINWAX Fast-Drying Polyurethane Clear Gloss overhead with a brush to a ceiling without wearing eye protection.

29 CFR 1926.300(b)(2):     Belts, gears, shafts, pulleys, sprockets, spindles, drums, fly wheels, chains, or other reciprocating, rotating or moving parts of equipment shall be guarded if such parts are exposed to contact by employees or otherwise create a hazard. Guarding shall meet the requirements as set forth in American National Standards Institute, B15.1-1953 (R1958), Safety Code for Mechanical Power-Transmission Apparatus.    Jobsite - On or about October 16, 2012 an employee operated a Craftsman 10 inch table saw without a guard covering the 5/16 inch drive belt.

29 CFR 1926.304(h)(1):     Each circular crosscut table saw shall be guarded by a hood which shall meet all the requirements of paragraph (i)(1) of this section for hoods for circular ripsaws.    Jobsite - On or about October 16, 2012 employees operated a Craftsman 10 inch table saw without a saw blade hood guard. The blade was 2 inches above the table surface.

29 CFR 1926.451(e)(1):     When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.    Jobsite - On or about October 16, 2012 employees used the end braces of a welded frame scaffold to access/egress the top level of the scaffold.

Jobsite - On or about September 17, 2012 employees working from a welded frame scaffold had not been trained on how to recognize and prevent scaffold hazards, such as:    1. Planking not overlapped over supports at least 12 inches or restrained to prevent movement  2. Scaffold not fully planked  3. Climbing scaffold bracing to access/egress scaffold

Listed, labeled, or certified equipment shall be installed and used in accordance with instructions included in the listing, labeling, or certification.    Jobsite - On or about October 16, 2012 employees use a hand-made extension cord. The extension cord was made of parts designed for permanent installation.
