OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazard:    a. On or about October 16, 2012, an employee releasing air pressure from a 20-40-inch pneumatic pipe plug entered into the danger zone and was struck by the plug as the air pressure was released.    Among other means, one feasible method and acceptable abatement methods to correct the hazard is to follow the manufacturers general safety and usage instructions on page 5 which states, Never enter the danger zone! The danger zones exist in front of the plugged pipe opening in the area which expands outwardly in a cone shape.

On or about October 17, 2012, on the barge "Carla", the TEREX all-terrain crane did not have a load chart that reduced the cranes capacity for use on a barge, exposing employees to be struck by the crane or suspended loads.
