Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which is free from recognized hazards that cause or likely to cause death or serious physical harm to employees, in that the employee who rode the bucket of the hydraulic excavator into a trench was not protected from fall or struck by hazards:    A. Saintignon Excavating Company worksite located at St. Rt. 118 & Hoffman St., Ohio City, Ohio:  The employer did not prohibit employees from riding the bucket of the John Deere 200DLC hydraulic excavator in or to be lowered in to an approximately 8 foot deep excavation.  The employee was thereby exposed to fall or struck by hazards due to the potential inadvertent operation of the equipment, as observed on October 16, 2012.

29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, was not protected by protective helmets:    A. Saintignon Excavating Company worksite located at St. Rt. 118 & Hoffman St., Ohio City, Ohio: On or about October 16, 2012, the employer did not ensure employees were protected from head injuries while working in and around a trench installing a sanitary sewer line. Due to this condition, employees were potentially exposed to impact injuries caused from falling material and/or struck-by equipment hazards.

A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.    A. Saintignon Excavating Company worksite located at St. Rt. 118 & Hoffman St., Ohio City, Ohio: On or about October 16, 2012, the employer failed to ensure a safe means of egress such as a ladder was provided to employees installing sanitary lines in a trench approximately 8.00 feet deep.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:    A. Saintignon Excavating Company worksite located at St. Rt. 118 & Hoffman St., Ohio City, Ohio: On or about October 16, 2012, the employer failed to ensure employees were protected from cave-in/collapse hazards while installing a sanitary sewer line in a trench approximately 8.00 feet deep. The employee was locating utilities in the trench prior to the trench box being installed.      B. Saintignon Excavating Company worksite located at St. Rt. 118 & Hoffman St., Ohio City, Ohio: On or about October 15, 2012, the employer failed to ensure employees were protected from cave-in/collapse hazards while installing a sanitary sewer manhole in a trench approximately 8.00 feet deep. Employees were exposed while installing the manhole without a trench box.
