29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: Jobsite located at 321 N. Rutland St., Wichita, KS 67206; employees engaged in residential roofing work on a 10 in 12 pitched roof were exposed to fall hazards of up to 8 feet, 10 inches from the eave to the ground. Fall protection available at the jobsite was not used.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: Jobsite located at 321 N. Rutland St., Wichita, KS 67206; employees using the portable extension ladder to access the roof were exposed to fall hazards of up to approximately 8 feet 10 inches to the ground. The siderails extended approximately 18 inches above the landing surface of the roof.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards: Jobsite located at 321 N. Rutland St., Wichita, KS 67206; employees had not been trained to recognize and minimize hazards associated with ladder use. Employees using a ladder the siderails extending less than three feet above the landing surface of the roof were exposed to fall hazards of up to approximately 8 feet 10 inches from the ladder to the ground.
