OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: On or about October 15, 2012, employees performing steel erection activities using a Genie scissor lift were standing on the mid and top guard rails without fall protection, exposing the employees to the hazard of falling approximately 19 feet to the ground below.

29 CFR 1926.753(d)(1): The employer did not ensure that routes for suspended loads were pre-planned to ensure that no employee is required to work directly below a suspended load: On or about October 15, 2012, employees performing steel erection activities were hoisting a steel beam for connection and an employee was working below the suspended load. The employee was exposed to the hazard of being struck by and crushed by the suspended load.
