29 CFR 1910.1052(d)(1)(i):   Where methylene chloride was present in the workplace, the employer did not determine each employee's exposure by taking personal breathing zone air samples or taking personal breathing zone air samples that are representative of each employee's exposure:    a) Shop area - Employees use a product called "MEI Eco-Canister System Adhesive 22-18" which contains 40 - 50% Methylene Chloride to glue insulation onto ductwork.  The employer did not determine each employee's exposure to methylene chloride by taking personal breathing zone air samples or representative personal breathing zone air samples; on or about 2/28/13.    Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1910.1052(f)(3)(i):     The employer did not implement procedures to detect leaks of methylene chloride in the workplace and did not make provisions to contain any spills and to safely dispose of any methylene chloride contaminated waste materials:    a) Shop Area - Employees use a product called "MEI Eco-Canister System Adhesive 22-18" which contains 40 - 50% Methylene Chloride to glue insulation onto ductwork.  The employer did not implement procedures to detect and contain methylene chloride leaks in the workplace.  The employer did not provide safe means to dispose of methylene chloride waste materials, on or about 2/28/13.    Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1910.1052(g)(3)(i):     The employer did not select and provide to employees, the appropriate atmosphere-supplying respirator specified in 29 CFR 1910.134(d)(3)(i)(A) and selected or used half masks:    a) Shop area - Employees use a product called "MEI Eco-Canister System Adhesive 22-18" which contains 40 - 50% Methylene Chloride to glue liner onto ductwork.  The employer provided employees with dust masks and not an appropriate atmosphere-supplying respirator when using this product; on or about 2/28/13.    Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1910.1052(h)(1):     Where needed to prevent methylene chloride induced skin or eye irritation, the employer did not provide clean protective clothing and equipment resistant to methylene chloride, at no cost to the employee, and/or did not ensure that each affected employee used it:    a) Shop area - Employees use a product called "MEI Eco-Canister System Adhesive 22-18" which contains 40 - 50% Methylene Chloride to glue insulation onto ductwork.  The employees wore canvas gloves when handling methylene chloride and were not provided with appropriate personal protective equipment that is impervious to methylene chloride; on or about 2/28/13.    Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1910.1052(k)(1)(ii):     The employer did not communicate the following hazards associated with methylene chloride on labels and in material safety data sheets in accordance with the requirements of the Hazard Communication Standard 29 CFR 1910.1200, 29 CFR 1915.1200, or 29 CFR 1926.59 as appropriate: cancer, cardiac effects (including elevation of carboxyhemoglobin), central nervous system effects, liver effect, and skin and eye irritation:    a) Shop Area - Employees use a product called "MEI Eco-Canister System Adhesive 22-18" which contains 40 - 50% Methylene Chloride to glue insulation onto ductwork.  The employer did not communicate the health hazards associated with methylene chloride to the affected employees, on or about 2/28/13.
