29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). a) At the jobsite, employees in the process of replacing 16" chiller pipes were exposed to a cave-in/engulfment hazard while working in an unprotected excavation 9 foot in depth. The north and west walls were nearly vertical. The soil was previously disturbed. No protective system (shoring, shielding sloping) was provided for employee protection, observed on or about about 10/16/12. TUCKER PAVING, INC., WAS PREVIOUSLY CITED FOR VIOLATIONS OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.652(a)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 315274084, CITATION NUMBER 1, ITEM NUMBER 4, WHICH WAS AFFIRMED AS A FINAL ORDER ON 05/14/2011 WITH RESPECT TO A WORKPLACE LOCATED AT 6000 CYPRESS GARDEN BLVD, WINTER HAVEN, FL.
