29 CFR 1926.404(b)(1)(i):     Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites:    a) On or about 10/17/12 at the Frewsburg Water District Well #5 project located at 1715 Wahlgren Road, Frewsburg, New York; employees were using a Dewalt screw gun to attach steel flashing pieces. The screw gun was plugged into an extension cord that went to a receptacle that was not protected by a ground fault circuit interrupter and there was no assured equipment grounding conductor program in place.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.502(b)(1):     The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level:    a) On or about 10/17/12 at the Frewsburg Water District Well #5 project located at 1715 Wahlgren Road, Frewsburg, New York; the side walls of a new concrete tank, that was 8 feet deep, were only 29" above grade.    NO ABATEMENT CERTIFICATION REQUIRED
